Surrogate Mother for NRI/OCI/PIO couples made Easy in India!

admin Blog, Surrogate Mother Leave a Comment

Looking to start or grow a family with the help of a surrogate mother in India? More NRI, OCI, and PIO couples are choosing India for surrogacy. It offers hope where traditional routes can be difficult. Yet, navigating the legal, emotional, and logistical hurdles might seem complicated. The good news is that India has made this process easier for international families.

Clear laws, expert clinics, and trusted agencies help make surrogacy in India accessible and secure for non-resident couples. Because of its sophisticated medical system and welcoming legal system, India has emerged as a popular surrogacy destination, particularly for NRI (Non-Resident Indian), OCI (Overseas Citizen of India), and PIO (Person of Indian Origin) couples.

To guarantee moral and open procedures, the Surrogacy (Regulation) Act, 2021, has simplified the procedure. Only altruistic surrogacy in which the surrogate receives no compensation beyond pregnancy-related and medical costs, is allowed by law for couples of Indian descent. With well-defined qualifying requirements, legal protections, and nationwide access to skilled fertility specialists, this rule provides NRI/OCI/PIO couples with a clear legal route to parenthood in their home country.

Understanding Surrogacy in India: An Overview

Surrogacy in India

What is Surrogacy?

Surrogacy is when a woman carries a baby for intended parents who cannot do so themselves. There are two main types:

  • Gestational Surrogacy: The surrogate mother carries an embryo created from the parents’ eggs and sperm. She has no genetic link to the baby.
  • Traditional Surrogacy: The surrogate uses her own egg with the sperm of the intended father or donor, making her the biological mother.

India has become a popular destination mainly because of its affordable options and advanced healthcare. Many couples from abroad find it easier to get quality services here.

Legal Framework Governing Surrogacy in India

India does not allow commercial surrogacy for foreign couples. The Surrogacy (Regulation) Bill, 2021 sets strict rules, mainly focusing on ethical and legal safety.

Key points for NRI/OCI/PIO couples:

  • Surrogacy is only allowed for Indian passport holders and OCI Card holders under certain conditions.
  • International intended parents with OCI Cards must work with licensed clinics and companies.
  • All surrogacy agreements must be signed legally and registered. All Legal Approvals from surrogacy boards and court must be taken by the couple as per new law.
